Business Associates (BAs) of Covered Entities under HIPAA, became statutorily obligated to comply with the HIPAA Security Rule in February 2010, a year after The HITECH Act was passed. Additionally, the Final Rule, published in the Federal Register on January 25, 2013, extends the definition of “business associate” to include a “subcontractor that creates, receives, maintains, or transmits protected health information on behalf of the business associate.”  The Final Rule is effective on March 26, 2013. Covered entities and business associates of all sizes will have 180 days beyond the effective date to come into compliance with most of the Final Rule’s provisions. Most BAs and their Agents are not compliant and many don’t know where to start. Do you? The Challenge

Business Associates (BAs) of Covered Entities under HIPAA, became statutorily obligated to comply with the HIPAA Security Rule in February 2010, a year after The HITECH Act was passed. On January 25, 2013, the Final HIPAA Rules were published, extending the definition of  “business associate” to include a “subcontractor that creates, receives, maintains, or transmits protected health information on behalf of the business associate.” The Final Rule is effective on March 26, 2013. In several 2012 speeches and interviews, Leon Rodriguez, Director of the Office for Civil Rights (OCR) has strongly urged BAs to become and remain compliant. In a December 2012 interview with Healthcare IT News, he stated,” My advice to business associates is to get in compliance now, because it’s what you’re supposed to be doing anyway for the benefit of your clients, and it’s going to avoid a lot of problems down the line.

CEs, BAs and their respective subcontractors create a “chain of trust” or “custody of trust” when it comes to creating, receiving, maintaining or transmitting Protected Health Information (PHI) and electronic PHI (ePHI). With the surge in the amount of PHI being exchanged, ensuring its protection is a huge challenge that depends on alignment of privacy and security goals.
